On 7 February 2019, the consultation ended on a draft bill that would allow companies to invoke a 250 days' reflection period in the case of an unsolicited takeover attempt or certain kinds of shareholders' activism.


On the government's website, one can see that there are 25 public responses. The vast majority of the input supplied by Dutch entities shows support for this new draft bill. With no exception, all the foreign responses were negative.
It therefore very much looks as a 'battle' between the Dutch establishment against the rest of the world.


The Justice minister will now review all the response received during this consultation. A decision on any next steps should not be expected until in a number of months from now.
